1. Introduction

These Terms and Conditions (“Terms”) govern the relationship between Nature Pulse Expeditions (“Nature Pulse Expeditions”, “we”, “us”, “our” or “the Company”) and any person who makes a booking, purchases a service or participates in a tour, safari, excursion, transfer or other service provided or arranged by us (“the Customer”, “you” or “your”).

By making a booking with Nature Pulse Expeditions, you agree to these Terms.

Where a third-party booking platform’s mandatory terms apply to a booking, those terms may supplement or, where applicable, take precedence over these Terms.

2. Our Services

Nature Pulse Expeditions provides tourism and travel-related services, which may include:

  • Wildlife safaris;
  • Mountain trekking;
  • Cultural tours;
  • Nature excursions;
  • Adventure activities;
  • Day trips;
  • Multi-day tours;
  • Airport transfers;
  • Transportation;
  • Accommodation arrangements;
  • Other travel-related services.

Specific services included in your booking will be stated in your booking confirmation or itinerary.

3.Making a Booking

A booking request does not become confirmed until Nature Pulse Expeditions has accepted the booking and the required payment or deposit has been received.

Once confirmed, we will provide booking information, which may include:

  • Tour itinerary;
  • Travel dates;
  • Pickup details;
  • Accommodation;
  • Included services;
  • Excluded services;
  • Payment requirements;
  • Cancellation conditions.

4. Customer Information

Customers are responsible for providing accurate information necessary to arrange their trip.

This may include:

  • Full names;
  • Passport information;
  • Nationality;
  • Flight details;
  • Accommodation details;
  • Contact information;
  • Emergency contact details;
  • Special requirements.

We are not responsible for consequences arising from incorrect or incomplete information supplied by the customer.

5. Prices

Prices are based on the information available at the time of booking.

Prices may vary depending on:

  • Travel dates;
  • Number of travelers;
  • Accommodation;
  • Seasonal rates;
  • Park fees;
  • Government taxes;
  • Transportation;
  • Supplier prices;
  • Currency fluctuations;
  • Changes in applicable fees.

Unless otherwise stated, prices will be quoted in the currency specified in the booking confirmation.

6. Payments

The required deposit or full payment must be made according to the booking confirmation.

Failure to make required payments by the stated deadline may result in cancellation of the booking.

Any bank, payment-processing or transfer charges may be payable by the customer unless otherwise agreed.

7. Cancellation

Cancellation is governed by the Nature Pulse Expeditions Cancellation and Refund Policy applicable to your booking.

Where different cancellation terms are stated in your booking confirmation, those terms may apply.

8. Changes to Bookings

Customers may request changes to:

  • Travel dates;
  • Number of travelers;
  • Accommodation;
  • Activities;
  • Pickup locations;
  •  

Changes are subject to availability and may result in additional charges.

We will make reasonable efforts to accommodate requests but cannot guarantee that changes will be possible.

9. Itinerary Changes

Safari and travel itineraries may occasionally need to be changed due to:

  • Weather;
  • Wildlife conditions;
  • Road conditions;
  • Park regulations;
  • Safety considerations;
  • Accommodation availability;
  • Government requirements;
  • Operational considerations;
  • Force majeure events.

We will make reasonable efforts to maintain the advertised itinerary while prioritizing safety and service quality.

10. Accommodation

Accommodation shown in an itinerary may be subject to availability.

Where the specified accommodation is unavailable, we may provide a comparable alternative.

Where the alternative has a higher cost, we will communicate the applicable additional charge where reasonably possible.

11. Wildlife and Safari Activities

Wildlife sightings cannot be guaranteed.

Animals are wild and their behavior, location and visibility are unpredictable.

Nature Pulse Expeditions does not guarantee that customers will see any particular animal, including:

  • Lions;
  • Leopards;
  • Cheetahs;
  • Elephants;
  • Rhinos;
  • Giraffes;
  • Wildebeest;
  • Other wildlife.

Customers must follow the instructions of guides, drivers, park authorities and accommodation staff.

12. Safety

Customers must comply with reasonable safety instructions provided by:

  • Nature Pulse Expeditions;
  • Guides;
  • Drivers;
  • Park authorities;
  • Accommodation providers;
  • Activity operators.

Customers must not intentionally place themselves, other travelers, staff or wildlife at unnecessary risk.

We reserve the right to refuse participation in an activity where we reasonably believe a customer’s conduct creates a significant safety risk.

13. Health and Fitness

Customers are responsible for ensuring that they are medically and physically capable of participating in the activities they book.

Certain activities, including trekking, hiking and adventure activities, may involve significant physical exertion.

Customers should seek appropriate medical advice before participating where necessary.

Customers should inform us in advance of relevant conditions or requirements that may affect the safe provision of the service.

14. Travel Documents

Customers are responsible for obtaining and carrying all required:

  • Passports;
  • Visas;
  • Vaccination documentation where applicable;
  • Travel permits;
  • Tickets;
  • Insurance documentation;
  • Other required travel documents.

Nature Pulse Expeditions is not responsible for costs arising from failure to obtain or carry required documents.

15. Travel Insurance

We strongly recommend comprehensive travel insurance.

Travel insurance should cover, where appropriate:

  • Medical treatment;
  • Emergency evacuation;
  • Trip cancellation;
  • Trip interruption;
  • Lost baggage;
  • Travel delays;
  • Personal liability;
  • Other travel risks.

Unless expressly stated in writing, travel insurance is not included in the price of our tours.

16. Personal Belongings

Customers are responsible for their personal belongings.

Nature Pulse Expeditions is not responsible for loss, theft or damage to personal property except to the extent required by applicable law.

Customers should avoid bringing unnecessary valuables on safari.

17. Photography and Personal Use

Customers may take photographs and videos during tours subject to:

  • Park regulations;
  • Wildlife protection requirements;
  • Local customs;
  • Privacy considerations;
  • Restrictions imposed by accommodation providers or activity operators.

Customers should obtain permission before photographing individuals where appropriate.

18. Responsible Tourism

Customers agree to behave responsibly and respectfully toward:

  • Wildlife;
  • Local communities;
  • Guides;
  • Drivers;
  • Other travelers;
  • Accommodation staff;
  • Protected areas;
  • Cultural sites.

Customers must not engage in illegal wildlife activities or intentionally damage the environment.

19. Alcohol and Illegal Substances

Customers must comply with applicable Tanzanian laws regarding alcohol and controlled or illegal substances.

A customer whose conduct is affected by alcohol or other substances and creates a safety risk may be removed from an activity without refund, subject to applicable law.

20. Customer Conduct

Nature Pulse Expeditions reserves the right to take reasonable action where a customer:

  • Behaves abusively;
  • Threatens staff or other guests;
  • Damages property;
  • Disregards safety instructions;
  • Engages in illegal activity;
  • Harasses other people;
  • Seriously disrupts the tour.

This may include terminating the customer’s participation without refund where permitted by law.

21. Third-Party Suppliers

Some services are provided by independent third parties, including:

  • Hotels;
  • Lodges;
  • Camps;
  • Airlines;
  • Transport providers;
  • Activity operators;
  • Park authorities;
  • Restaurants;
  • Other tourism providers.

Such providers may have their own terms and conditions.

We will make reasonable efforts to work with reputable suppliers but cannot control every aspect of their independent operations.

22. Force Majeure

Nature Pulse Expeditions shall not be responsible for failure or delay in performing services caused by circumstances beyond our reasonable control.

Such circumstances may include:

  • Natural disasters;
  • Severe weather;
  • Floods;
  • Earthquakes;
  • Epidemics or pandemics;
  • Government restrictions;
  • War;
  • Civil unrest;
  • Terrorism;
  • Strikes;
  • Road closures;
  • Park closures;
  • Political disturbances;
  • Transport disruption;
  • Supplier failure;
  • Other extraordinary events beyond our reasonable control.

Where possible, we will work with customers to identify reasonable alternatives.

23. Liability

To the extent permitted by applicable law, Nature Pulse Expeditions will not be liable for losses arising from circumstances beyond our reasonable control.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.

We do not exclude liability for matters that cannot legally be excluded or limited under applicable law.

24. Assumption of Inherent Travel Risks

Customers acknowledge that travel and outdoor tourism activities may involve inherent risks, including:

  • Uneven terrain;
  • Wildlife encounters;
  • Weather conditions;
  • Road conditions;
  • Remote locations;
  • Physical exertion;
  • Mountain environments;
  • Water activities;
  • Transportation risks;
  • Other naturally occurring travel risks.

Customers should consider these risks when deciding whether to participate.

25. Complaints

Customers should raise complaints with Nature Pulse Expeditions as soon as reasonably possible so that we have an opportunity to investigate and resolve the issue during the trip where possible.

26. Privacy

Personal information provided to Nature Pulse Expeditions will be processed in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, disclose, store and protect personal information.

27. Intellectual Property

Unless otherwise stated, materials produced by Nature Pulse Expeditions, including:

  • Website content;
  • Logos;
  • Photographs;
  • Graphics;
  • Written itineraries;
  • Marketing materials;
  • Designs;
  • Branding;

are owned by or licensed to Nature Pulse Expeditions and may not be reproduced or commercially used without permission.

28. Website Information

We make reasonable efforts to ensure that information published on our website is accurate and current.

However, itineraries, accommodation, prices, availability and other information may change.

We reserve the right to correct errors and update information where necessary.

29. Governing Law

These Terms shall be governed by the applicable laws of the United Republic of Tanzania.

Any dispute shall, where appropriate, first be addressed through good-faith discussions between the parties.

Where a dispute cannot be resolved amicably, it may be referred to the appropriate courts or dispute-resolution mechanism having jurisdiction under applicable Tanzanian law.

30. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

31. Amendments

Nature Pulse Expeditions may update these Terms periodically.

The version applicable to a customer’s booking will generally be the version in effect at the time the booking is confirmed, unless otherwise required by law or agreed between the parties.

32. Entire Agreement

These Terms, together with the customer’s booking confirmation, itinerary, applicable cancellation policy and any other documents expressly incorporated into the booking, constitute the agreement between Nature Pulse Expeditions and the customer concerning the relevant services.
